摘 要:随着新型城镇化规模的不断扩大,大量农地转为建设用地,因征地引发的农地增值收益分配矛盾日渐突出。本文依据农地发展权的内涵与价值理论以及农地征收与合理补偿关系理论,从立法和实践两方面分析了在现行农地征收过程中农民和农村集体经济组织获取征地补偿的不合理性及其农地增值收益和征地补偿费分配的不公平性,在此基础上,提出了相应的建议:应对农村集体经济组织、被征地承包经营者及未征地承包经营者给予合理补偿。With the industrialization and the scope of the new urbanization continuously expanding,an abundant of agricultural lands turn into construction lands and the value-added income distribution contradiction of agricultural lands triggered by the land requisition is prominent day by day.The paper,based on the connotation and value theory of the agricultural land development rights as well as the theory of expropriation of agricultural lands and reasonable compensation relationships,analyzes the irrationality of farmers and rural collective economic organizations acquiring compensation of the land requisition as well as unfairness of the added-value income of agricultural lands and compensation fee distribution of the land requisition in the process of current expropriation of agricultural lands from two perspectives of legislation and practice.And on this basis, the paper puts forward relevant suggestions that it should offer a reasonable compensation to rural collective economic organizations,contractors in the land requisition and contractors in no land requisition.
