摘　　要：鉴于海洋环境侵权具有迥异于一般环境侵权的特殊性,需对海洋环境公益进行类型化分析,以期合理配置不同类型海洋环境公益诉讼的适用规则。针对我国国情及海洋环境污染的现状,我国海洋环境公益诉讼应有三种类型:涉及国家环境利益的海洋环境公益诉讼、涉及社会公共利益的海洋环境公益诉讼和非纯粹的海洋环境公益诉讼,每种类型的海洋环境公益诉讼在原告资格、救济对象及程序规则上均有特殊性。Considering the uniqueness of the infringement of oceanic environment from the common infringement of envi- ronment,analyze should be made in the categories of the public welfare of oceanic environment to properly suit the var- ious applicative rules of oceanic environment welfare.Considering the current situations in our country and of the con- tamination of environment,the lawsuits of the public welfare of oceanic environment in our country should be divided into the following three categories：the public welfare of oceanic environment concerning state environmental interests,that concerning social public interests,and the impure public welfare of oceanic environment,each of which has its own u- niqueness in accuser qualification,targets to be relieved and rules of procedure.
