摘 要:从信息经济学的角度分析医患纠纷,不难发现信息不对称现象客观存在于医疗市场当中,虽然它不是造成纠纷的惟一原因,但很大程度上导致了医患纠纷的发生并使之难以化解。这种“不对称”主要表现在作为需方的消费者即患方缺乏对医学信息、管理信息、制度信息和法律信息等的了解,从而导致对医疗服务行业的特殊性不理解,所以一旦自身利益受损失,医患纠纷便不可避免。此外,作为供方的医界内部也存在“信息不对称”现象,表现为有些医务人员忽视其执业范围内及与其执业相关的所有信息,从而导致医疗过失纠纷的发生。通过对此现象的分析,提出防范和化解医疗纠纷应从上述各个层面入手,特别是要在意识层面上充分尊重患方的知情权,以期达到矫正信息不对称的目的。The paper analyzed the dissension between doctors and patients with information economics and found information asymmetry phenomenon existing objectively in medicine market. Although information asymmetry phenomenon is not only reason why bring the dissension, it results in occurrence of the dissension between doctors and patients and can t solve the dissension in some ways. The shows of information asymmetry phenomenon are: the need lack information of medicine, management, system and law, and they don' t understand the particularity of medical services market, therefore, in case their benefits are losing, it is inevitable to take place the dissension between doctors and patients. Furthermore, there exist also information asymmetry phenomenon in the provider, it shows: some medical worker ignored all information that is interrelated with their profession so that brought the dissension between doctors and patients. By analyzing the phenomenon, the paper put forward measures of preventing and solving the dissension from the need and the provider, especially the patients' rights of knowing the facts should be respected so that information asymmetry phenomenon can be rectified.
