摘　　要：《与台湾关系法》尽管违反了中美三个联合公报以及相关国际法基本原则,但仍然具有美国国内法的性质,并将在美国国家机器的保障下予以执行。相对于此前的《美台共同防御条约》,该法在美台关系的性质界定上具有较强的隐蔽性,在美台关系的内容设定上具有更大的广泛性,在美台权利义务的分担模式上具有单务性和实践性。该法的法律实效具有先天的不稳定性,在执行过程中将势必大打折扣,难以达到其制定者所想要起到的效果。Although Taiwan Relations Act violates the three Joint Communiqu6 of the United States of A- merica and the People＇s Republic of China, and also violates relative international legal principles, it is still a domestic law of US and will be enforced by the government of US. Compared to the Mutual Defense Treaty between the USA and ROC before, this Act makes more concealment on the definition of US-Taiwan Rela- tions, regulates wider scope of US-Taiwan Relations, and grants certain unilateral and practical characters on the sharing mode of the two parts＇ rights and obligations. So unlike the framer of this Act had expected, the legal effect of this Act is inherently unstable aud doomed to he discounted in performance.
