摘 要:预防腐败呼唤行政程序法治。行政程序法治包括行政决策、行政执行和行政监督的程序法治。为实现预防行政腐败的目的,行政决策程序法治要求建立重大行政决策事项公开制度,并设计回避、参与和议事等重要程序规则供所有行政决策遵循;行政执行程序法治除了要求完善公开制度、告知制度等基本的程序制度外,还要求重点细化说明理由和证据制度;行政监督程序法治则要求建立和完善公开与公众参与制度和正当程序制度。Preventing corruption need administrative procedure legislation. The legislation of administrative procedure comprises of the legislation of procedure of administrative decision-making, enforcement and supervision. In order to prevent corruption, the legalization of administrative decision-making requires the establishment and im- provement of major administrative decisions on matters of public institutions and administrative decision-making process itself in the avoidance rules, rules of procedure participation and rules of order. The legalization of adminis- trative enforcement requires the establishment and improvement of the reasons the system and evidence system, as well as open system, informing system. The legalization of administrative supervision needs to establish and perfect the system of openness and public participation and due process.
