摘　　要：《海峡两岸投资保护与促进协议》的签署展开了两岸投资领域制度化合作的新篇章,《海峡两岸投资保护与促进协议》除包含一般投资协定应有的内容外,在投资与投资者的概念、投资待遇、争端解决机制等方面也形成了自身的特色和创新,但《海峡两岸投资保护与促进协议》的实施仍然存在诸多法律障碍,需海峡两岸进一步协商,对模糊用语进行解释,完善争端解决机制,制定配套规则,各自修订法律法规等,以真正发挥其保护和促进两岸投资的作用。The signing of＂Cross-strait Investment Protection and Promotion Agreement＂,which has opened a new chapter for the cooperation of cross-strait institutionalized investment.In addition to the general investment agreement,＂Cross-strait Investment Protection and Promotion Agreement＂has its own characteristics.It clearly defines the concept of the investment and the investor,clarified the meaning of investment treatment and created the unique system of dispute settlement.But there are many legal obstacles in the implementation of the agreement.Further consultation,interpretation of vague language,improving the dispute settlement mechanism,supplementary rules-making and revision of related laws and regulations are necessary to give full play to the role of promotion and protection of investment.
