摘 要:2015年,修订后的《中华人民共和国环境保护法》《国家突发环境事件应急预案》以及新制定的《突发环境事件应急管理办法》《国家海洋局海洋石油勘探开发溢油应急预案》相继颁行,为中国完善海上溢油应急管理的法律规范提供了支持,也仍有不足。近年来在中国海域进行的溢油应急暴露出应急机构、应急预防、应急预警和应急处置等方面的问题,有鉴于此,中国海上溢油应急管理立法的指导思想亟待更新,应当完善海上溢油应急管理组织体系,建立区域联动制度、信息通报制度、溢油模拟评估机制,规制海上溢油应急处置。In the process of emergency management of marine oil spill in China, there exposes the problems in aspects of e- mergency organization, emergency prevention, emergency warning and emergency disposal. Combining with the newly revised Environmental Protection Law of the People' s Republic of China and National Environmental Emergency Response Plan, the newly enacted Measures for the Administration of the Emergency Environmental Accidents, Measures on Environmental Emer- gency Response Management and Emergency Response Plan of the State Oceanic Administration for Oil Spills During Offshore Oil Exploration and Development, suggestions have been put forward on improving the organization system of marine oil spilling, establishing the regional linkage regime, the information reporting system and the oil spilling simulating and assessing mechanism. Legislation on emergency disposal and other detailed, feasible legislation suggestions have also been discussed.
