信访的权利救济功能及其理性实现

摘　　要：我国正处于社会转型时期,社会矛盾频发,日趋复杂化、多样化。信访制度在化解社会矛盾中扮演的重要的角色已经不言而喻。但是信访外部环境的错综复杂和信访制度本身的内在缺陷的双重压力导致了信访困境日趋严重,这引起了理论层面上对于信访权利救济功能的热议。各种理论观点的提出促使我们对信访权利救济功能重新进行审视。信访的权利救济功能与其公民政治参与、意见表达功能不可分离。通过信访权利救济功能进行正当性论证,进而探求信访权利救济功能的实现路径,从而促使信访在社会矛盾纠纷解决中承担更重要的责任。China has been in the social transformation period. Social contradictions take place constantly and become more and more complicated and variable. As we all know, the petition system plays an important role in dissolving social contradictions. But the petition system is suffering from the complicated and confused external environment and the inherent defects of it. These double pressure and challenges cause increasingly serious predicament of the petition system, which arouse a heated discussion about the right relief function of the petition system in the current theoretical circle. The proposition of different theoretical viewpoints urges us to re-examine the right relief function of the petition system. The right relief function and political participation function of the petition system are interdependent and cannot be separated. Through the justification of the rule of law about the right relief function of the petition system, we can seek the solutions to the legalization of the right relief function of petition system, which prompt the petition system to take a more important role in dissolving the social conflicts and disputes.
