论以审判为中心的诉讼制度改革背景下新型侦诉关系之构建——以检察机关自侦部门为视角

摘　　要：推进"以审判为中心"的诉讼制度改革,是新时期对我国"分工负责、互相配合、互相制约",也即"阶段论"侦诉审关系的完善和发展。以审判为中心的诉讼制度改革背景下构建新型的侦诉关系,除"有形"的建章立制层面的完善外,更为重要的是"无形"的,亦即二者在心理上对彼此工作价值的认同。此外,还应围绕证据问题,对原有侦诉关系进行进一步黏合。The promotion of reformation of trial-centered procedural system is to hold responsibility for what a person is in charge of, to cooperate with each other and to restrict each other in the new era, which is to develop and perfect the relationship between investigation, prosecution and trial. Against the background of reformation of trial-centered procedural system, to establish new relationship between investigation and prosecution is to perfect written laws and regulations and unwritten ones. Their values should be psychologically recognized. What＇s more, to revolve around evidences, investigation and prosecution should be further combined.
