摘  要:回应权是名誉损害救济的重要方式之一。基于该权利,被报道者有权要求报道媒体在原报道的同一版面、同样字体及篇幅免费刊登回应文章。回应权可以发挥救济名誉损害、减轻媒体诉讼压力与促进资讯多元等功能。我国《出版管理条例》虽规定了该制度,但其适用规则及法律效力并不明确。在比较研究基础上,建议回应权的适用范围应当扩张至所有媒体形式,包括印刷媒体与广电媒体,并主要限于事实报道的情形。被报道者行使回应权的,应当限制媒体名誉侵权责任的范围。The right to reply is one of remedies to damaged reputation,which allows the aggrieved party to compel the publication to make a reply to the original statement on the same layout with the same font size and length for free. The right to reply can play a multi- functional role in offering remedies to damaged reputation,mitigating the stress of media in defamation litigation and promoting diversity of public information. Although such right is formulated in Regulations on the Administration of Publication of P. R. C,its applicable rules and legal effects are not specific. Based on comparative research,it is suggested that the right to reply should be applied to all kinds of media services including press,broadcasters and televisions,being confined to the scope of factual assertions. Besides,in exercise of the right to reply,the extent of defamation tort liability should be restricted.
