摘　　要："存活或治愈机会"属于侵权法保护的客体,患者机会丧失造成的损害理应获得赔偿。但这种赔偿与一般的侵权损害赔偿相比在责任构成及赔偿路径等方面都有其自身的特殊性。＂Survival chance＂ belongs to the object of tort law protection, and the patients＇ dam- age deserves compensation if the damage is made by ＂lost of chance＂. Compared with general tort damage compensation, this kind of compensation is different on aspects such as constitution of the responsibility and method of compensation.
