摘 要:历时四年的公约气候谈判以及公约外的各种行动将保证巴黎会议如期达成"巴黎气候协议"。"巴黎气候协议"将集中体现国际气候合作制度新的机制和安排。"CBDRRC"原则在"巴黎气候协议"中仍有不可动摇的地位,但内涵有所拓展;各缔约方将"自下而上"地承担减缓目标或行动;就具体内容而言,在减缓、适应和透明度领域,各缔约方行动的性质和约束力基本一致、行动力度符合"国情"、透明度规则渐进趋同;在资金、技术和能力建设领域,保持传统"二分"状态有可能性,但应允许和倡导有能力的国家自愿承担提供支持的义务。"巴黎气候协议"的法律形式将以一种公约下未出现过的形式承载。Climate talks that have been negotiatedfor 4 years under UNFCCC and all kinds of activities outside UNFCCC would make "Paris Climate Agreement" as a deal on Paris Conference. New arrangements on international climate cooperation would be reflected in the Agreement. The principle of CBDRRC would be still the core of the Agreement, however, commitments or actions of parties would be initiated by a "bottom-up" approach and shown as spectrum mode. In the detailed content of the Agreement, regarding mitigation, adaptation and MRV, the attributes and blinding of parties' actions would be the same in the way that ambition of actions keep consistent with "national circumstance" and MRV rules convergence progressively. Regarding finance, technology and capacity building, it is possible to maintain the current situation differentiated by different groups of parties, but it also possible to allow non-Annex I parties voluntarily contribute to climate finance. Regarding the legal form, the Agreement would be carried by a kind of non-existing form under UNFCCC.
