论无益耗费旅游时间的损害赔偿

摘　　要：在旅游合同的履行过程中,因为可归责于旅行社的事由导致旅游挫败或者旅行社所提供的旅游服务不符合合同的约定时,旅游者除了有权要求返还已经支付的旅费外,还可就旅游时间的无益耗费向旅行社主张金钱损害赔偿。只要未在合同中约定情况发生变化时旅游者应该接受旅行社的替代方案,那么旅游者即有权拒绝该方案并主张旅游时间被无益耗费的损害赔偿。据以赔偿的时间范围,包括合同中所约定的旅游时间和因为旅行社的过错导致旅游者在旅途中滞留而延长的时间。赔偿标准则以约定的旅费为基准,根据旅行社违约的程度来酌减。旅游者事实上如何度过合同中所预订的旅游时间对赔偿额并没有减损的效果。In the performance of package travel contracts, when the travel package is no longer possible or the provided service does not in conformity with the agreements due to the fault of the travel agency, the tourist can claim from the travel agency for not only the restitution of the payment, but also an appropriate compensation in money for time cost to no avail. The claim herebefore exists only except as otherwise provided by contract that the tourist previously agreed to accept the alternative solutions offered by the travel agency under situations of this kind. The range of the cost time includes the normal tour-time as well as any stranding or delay due to the fault of the travel agency. The standard of damages is mainly based on the agreed payment of the service and could also be mitigated in accordance with the actual situation of contract breach. Nevertheless, how in reality the tourist spends the original tour-time has no effect on the damages.
