摘　　要：我国新刑事诉讼法在＂侦查＂一章中设专节规定了＂技术侦查措施＂,从而实现了技术侦查措施的法定化,并且立法规定通过技术侦查措施取得的材料可以直接作为诉讼证据使用而无须＂转化＂。一方面,新刑事诉讼法对技术侦查措施作出授权性规定解决了公安、检察机关使用时法律依据不足的问题;另一方面,新刑事诉讼法对技术侦查措施的种类、使用条件、对象以及审批程序、权利救济等基本问题均未作出明确规定,在缺乏必要程序规制的情况下,技术侦查措施的使用必然具有很大的随意性,存在着滥用的巨大风险。为了防止技术侦查措施成为脱缰的野马从而危及个人基本权利,有必要将技术侦查措施分为纯正技术侦查措施和非纯正技术侦查措施。由于纯正技术侦查措施的使用更容易对公民基本权利造成侵害,且侵权后果更为严重,因此应将其作为规制的重点,主要应从案件范围、使用时间、使用对象、使用期限、决定和执行主体、执行程序、监督措施、权利保障等八个方面进行规制。There is a special section in the chapter of ＂ investigation＂ about the ＂technical investigation measures＂ in China＇ s new Criminal Procedure Law, so as to realize the legalization of technical investigation measures, and the legislation makes the material on technical investigation measures be directly used as evidence in litigation without ＂transformation ＂. On the one hand, the new Criminal Procedure Law has made the authorization provisions on measures of technical investigation, solving the problem of lack of law basis, on the other hand, the new Criminal Procedure Law has not made clear stipulations about species, the use of conditions, objects and the examination and approval procedures, the right to relief and other basic problems of measures of technical investigation. In the absence of the necessary procedures for regulation, using technical investigation measures will inevitably exist great arbitrariness, there exists great risk of abuse. To prevent the phenomenon, the author will make technical investigation divide into pure and impure technical investigation measures, clarifying concepts to make proposal of legal regulation on pure technical investigation measures.
