对我国刑法人权保障制度的梳理与建议

摘　　要：文章阐释了刑法与人权的关系——保护人权是刑事法规范的应有使命之一;分析了我国刑法典等刑法规范在人权保障方面的内容;结合当前的实际提出了相关建议:在一般人权保障的领域,针对涉恐涉暴犯罪及黑社会性质的犯罪、涉毒涉嫖涉淫犯罪、涉及伪劣有毒有害产品类的犯罪、涉及民主法制与政治制度建设的犯罪、违背诚信风尚的犯罪,提出了增设相关罪名和加大惩罚力度的建议;在特殊人权保障领域,针对侵犯嫌疑人\被告人合法权益类犯罪、妨害律师履行职责类犯罪、直系亲属作证问题提出了加大惩罚力度、增设相关罪名等建议。This paper expounds the relationship between criminal law and human fights the protection of human fights is one of the proper mission of criminal law norms, analyzes China＇s criminal code （ such as criminal law ） in the field of protection of human fights, puts forward suggestions on additional related charges and increasing the punishment in the field of general protection of human rights including crimes involving violence, terrorism and underworld, drugs and prostitution, fake, poisonous and harmful products, democracy and legal system and political system, breach of fiduciary fashion ; in the field of special protection of human fights, proposes to increase penalties, additional charges and other related suggestions on crimes in violation of the legitimate fights and interests of criminal suspects and defendants, obstruction of lawyers to perform the duties, witness by immediate relatives.
