反腐新常态下贪污贿赂犯罪的立法完善

摘　　要：刑法修正案(九)(草案)需要注意修改条文和刑法原则的一致性以及新罪名的及时确定性。在贪污受贿罪数额和情节并重模式中要考虑情节犯理论影响下的四大因素。加大惩处行贿罪的同时要避免在受贿罪从宽情节方面对刑法总则的违反,建议去掉减少损害后果这一法定从宽情节;行贿罪需要参照受贿罪的定罪量刑标准设立数额标准,但不应舍弃谋取不正当利益的主观方面要件。我国应在立法上将贿赂犯罪标的范围从财物扩展到财产性利益,增设外国公职人员和国际公共组织官员受贿罪。刑法修正案本身的反思则不应局限于如何组合现有的修改方式,而应放眼整个刑事法领域的维度,推行经济犯罪(刑事)立法一体化的研究和落实。Amendment IX（ Draft） to Criminal Law of the P.R.C shall make new provisions meet the principles of Criminal Law and new accusation be certain in time. Four factors shall be considered in the mode of ＂amount＂ and ＂ circumstance＂ of Graft Crime and the Crime of Accepting Bribes according to circumstance crime theory. Punishing the Crime of Offering Bribes with increasing severity and avoiding violating the principles of Criminal Law with regard to circumstances of lesser punishment of the Crime of Accepting Bribes, we also advise deleting one circumstance of lesser punishment, namely ＂reduction of injury＂. The amount standard of conviction and sentencing for the Crime of Offering Bribes need to be set with reference to the Crime of Accepting Bribes and the subjective aspect of the crime, namely ＂seek illegitimate gain＂ shall be preserved. The scope of Bribery Crime shall be extended from ＂property＂ to ＂profit measured of property＂ and the Crime of Accepting Bribes for any foreign party performing official duties or officials of international public organizations shall be prescribed in Criminal Law. As for the reflections of amendment to Criminal Law, we shall take whole Criminal Laws area into consideration and promote researches and implementation of integrated criminal legislation on economic crimes instead of being limited into current amendment measures.
