记名提单的性质与放货问题研究

摘　　要：由于目前学界对记名提单(Straight B/L)的性质一直没有定论,所以在记名提单的转让性问题以及记名提单下承运人是否必须凭单放货的问题上存在现有法律规定不明、各国法律规定不同的状态。故有必要对记名提单的性质、可转让性以及记名提单下是否需要凭单放货的问题进行探讨,这不仅涉及到各国法律的不同规定,还关系到我国《海商法》对记名提单的规定应当如何完善的问题。The nature of Straight B/L has been no conclusion in the law field up till the present moment.So whether Straight B/L is transferable or not remains unclear in existing legislation, together with the question of whether the carrier has to deliver the goods based on the original bill of lading. Besides,Straight B/L in different countries has varied regulations. Therefore, it is necessary to discuss and study the nature of Straight B/L, transfer-ability and voucher delivery of goods, meanwhile, to figure out how to perfect provisions on Straight B/L in Maritime Code of PRC.
