摘　　要：援助义务是罗尔斯国际法哲学的重要内容,受到不少学者的质疑与否定。然而,罗尔斯的援助义务具有很强的说服力。国际社会并不存在一种全球的基本结构,使得差别原则不可能应用于其中。在多元的万民社会中,援助义务与差别原则相比更有望达成各"人民"重叠共识的核心。The duty of assistance is an important element of Rawls＇ philosophy of international law,though questioned by many scholars.However,Rawls＇ duty of assistance is very compelling.There does not exist a global structure in the global community,which makes it impossible to apply different principle.Moreover,in diversified society of peoples,the duty of assistance is expected to reach the core of overlapping consensus of peoples.
