摘　　要：目前,艾滋病(AIDS)已经从传统的高危人群之间传播,开始向普通人群扩散。艾滋病违法犯罪的特殊性表现在犯罪主体是艾滋病感染者的特殊身份上。如何对艾滋病违法犯罪进行适当定性以及如何执法是我国面临的主要法律难题,建议消除现行法律法规之间的矛盾,构建以专业执法人员为骨干的执法队伍,将防艾工作融入体制,并积极进行普法教育,构建协调统一的防艾法律体系,实现对艾滋病违法犯罪的法律规制。The AIDS epidemic has led to no one can stay out of spreading risk.The specific of AIDS crime performance in the subject of crime is the special status of AIDS infection persons.How AIDS crimes were identified and how law enforcement is one of the main challenges facing the legal profession in our country.Suggestions to eliminate the contradiction between laws and regulations,build professional law enforcement personnel as the backbone of the law enforcement team,blend in AIDS work system,carry out legal education actively,and construct harmonious and unified legal system of AIDS prevention,and to achieve legal regulation on AIDS crime.
