公共权力运行公开化语境下协商治理研究

摘　　要：协商治理的成长以协商民主为理论来源,受公共行政民主化的现实引导。协商治理在成长过程中面临着理性有限和能力不足,不平等和复杂性,以及共识障碍和价值偏离等问题的挑战,只有重视公共权力及其作用才能有效应对协商治理前提性、基础性和目标性的挑战。因此,需要从公共权力运行公开化的语境下寻求协商治理的发展之道,以公共权力维护协商治理的权威性,以公共权力运行保障协商治理的有效性;并在公共权力运行公开化过程中通过信息公开、结构开放和价值包容,不断提升协商治理参与者的理性和能力,保障协商治理过程的公平和条件的均衡,以及维护协商治理的合法性共识和公共精神,从而以积极、坦诚、负责任的态度服务于协商治理的可持续发展。The growth of deliberative governance relies on deliberative democracy as theoretical source, and guided by the reality of the public administration democratization. Deliberative governance faced with many challenges in the process of growth, such as limited rationality and insufficient capacity, inequality and complexity, consensus obstacles and value deviation and so on. Only by attaching importance to public administrative power and its role can we deal with the challenges of deliberative governance in premise, foundation and objective. Therefore, we need to seek the way to development of deliberative governance in the context of open operation of public administrative power. We should maintain the authority of deliberative governance by public administrative power, and guarantee the ef- fectiveness with the operation of public administrative power. Through the disclosure of information, the open of structure and inclusion of value in the process of open operation of public administrative power, we would constantly improve the reason and ability of participants, guarantee the fairness of process and equilibrium of condition, as well as maintain the consensus of legitimacy and public spirit of deliberative governance. Thereby, the open operation of public administrative power can serve sustainable development of deliberative governance in a positive, honest, and responsible attitude.
