海洋环境污染损害中纯经济损失赔偿法律问题探析——以海洋油污损害赔偿为视角

摘　　要：海洋环境污染损害影响面大,持续时间长,海洋生态环境与资源恢复原有状态过程缓慢,造成的纯经济损失涉及面也较普通环境侵权损害更广,一定范围内对其予以赔偿符合法律正义,有利于社会和谐稳定,也符合国际潮流趋势。我国应充分借鉴船舶油污损害赔偿公约体系和国外的立法和赔偿实践,结合已有的纯经济损失赔偿司法经验,完善海洋油污损害中纯经济损失的赔偿制度。The influence of damages in marine environmental pollution is broad and prolonged. Marine ecological environment and resources always need a long time to recover, of which the pure economic loss is wider than the normal environmental infringement. So it is justified to compensate for the damage within a certain range, and it helps to construct a stable and harmonious society, which is in accordance with world trends. China should learn from the convention system of the compensation for oil pollution damage and foreign countries＇ legislation and practice, combined with judicial experience, to perfect the compensation system of pure economic loss in damage of the marine oil pollution.
