摘 要:社会转型时期的我国新型劳动关系不断出现,工伤保险法律规范中规定的工伤认定标准又存在大量的不确定法律概念,如何将这些不确定法律概念具体化,是行政机关进行工伤认定时必须要解决的问题。同时,为保护劳动者合法权益和追求社会正义与公平,工伤认定行为必须接受司法审查,法院的审查程序也要进一步规范和完善。During the period of social transformation, new labor relations continue to emerge in our country. There are a lot of indefinite law concepts in the Regulation on Work-related Injury Insurance. It is a problem for the law enforcement office to solve that how to ascertainment these indefinite law concepts when they are faced with specific work-related injury cases. At the same time, to protect the legitimate rights and interests of workers and pursuit of social justice and fairness, the identification of work-related in- juring must be subject to judicial review. The court's review procedures also should be standardized and improved.
