摘 要:土地产权制度是农村经济发展和城乡二元结构转化的基础制度安排。本文探究了我国农村土地承包关系长久不变在制度、机制和操作三个层面的内涵,指出理解农村土地承包经营权期限应基于制度和机制内涵而展开。据此,本文立足于多重前置条件,指出土地承包关系长久不变条件下,我国农村的土地承包经营权期限可被界定为70年,起始年份可被界定为1999年。立足于土地承包关系长久不变与其他制度安排之间的互补性质,本文从土地集体所有制的界定、土地承包权与经营权的组合、土地承包经营权流转市场建构等多个维度出发,阐述了农村土地承包关系长久不变有效实施的条件。This paper explores the connotation of rural land contract relation permanency in China on three levels, i.e. institution, mechanism and operation, pointing out that the understand- ing of rural land contract right duration should be based on the connotation of institution and mecha- nism. Therefore, based on multiple prerequisites, this paper pointed out that, under the condition of rural land contract relation permanency, the land contracted management right duration can be de- fined as 70 years, while the starting year can be defined as the year of 1999. Based on the comple- mentary nature of the land contract relation permanency and other institutional arrangements, this paper elaborates the conditions for the long-term and effective implementation of the rural land con- tract relation permanency from several dimensions such as the definition of land collective ownership, the combination of land contract right and management right, and the construction of the market for the circulation of land contracted management right.
