党对军队绝对领导的法理基础

摘　　要：坚持中国共产党对军队的绝对领导有着坚实而充分的法理基础,这主要表现在以下三个方面:一是当今世界实行政党政治的国家普遍实行执政党领导军队的法律制度,我国法律上确立中国共产党对军队的绝对领导,合乎法律的公理性原则要求;二是我国国防法上确立中国共产党对军队的绝对领导,不仅准确地体现了宪法的精神实质,而且在宪法上有明确的条文规范作为根据,因而合乎法律的合宪性原则要求;三是坚持中国共产党对人民军队的绝对领导,作为我国国防法上的一项基本法律制度,不仅有利于中国特色社会主义正义事业在中国共产党的领导下顺利推进,而且有利于维护最广大人民的根本利益,因而在实质意义上真实地体现了法律的正义性原则要求。As an essential military law system established by the National Defense Act , to adhere to the Chi-nese Communist Party＇s absolute leadership over the armed forces has a solid and sufficient nomological basis , which is mainly manifested in the following three aspects：First, as the military law system of the ruling party＇s ab-solute leadership over the armed forces is in general practice in countries which implement party politics all over the world, the establishment of the Chinese Communist Party＇s absolute leadership over the army on our law is just in line with the requirements of the legal principle of being axiomatic .Secondly , the establishment of the Chinese Communist Party＇s absolute leadership over the armed forces on our National Defense Act not only accurately reflects the spirit of the Constitution , but also has a clear constitutional provision norm as a basis , and therefore keeps in line with the requirements of the principle of the constitutionality .And the third, to uphold the absolute leadership of the Communist Party of China over the People＇s Army, as a basic military law system in China＇s National Defense Act, is not only conducive to the smooth progress of the justifiable cause of the socialism with Chinese characteris -tics under the leadership of the Communist Party of China , but also conducive to safeguarding the fundamental in-terests of the overwhelming majority of the people , and therefore truly embodies the requirements of the legal princi-ple of being justifiable in the real sense .
