摘 要:城镇化的快速推进引发了新一轮"圈地运动",大量农民的土地权益受损,无法共享地利。本文以城镇化中的农民土地权益保障为视角,结合本土实际,对我国农村土地发展权的性质与归属进行再思考,认为在我国现有的宪法秩序与法律框架下,我国农地发展权是派生于所有权的农地使用权中的一个独立权能,是公权力对农民私权利的一种权利让渡。同时它也是有限度的,即必须服从于国家基于公共利益的规划。在厘清其性质的基础上,根据我国农村土地用途的多元特性,将农村土地发展权分为耕地发展权、宅基地发展权与经营性建设用地发展权,并分别对其归属进行了探讨。The rapid advance of urbanization triggered a new round of "Enclosure Movement", which causes damage of a large number of farmers'land rights and interests. They cant share the profit brought by the land. From the perspective of protecting farmers' land fight in Urbanization, this paper analyzes the nature and ownership of China' s rural land development rights on the basis of local real- ity. This paper holds that under the framework of China' s current constitutional order and law, China' s rural land development right is an independent fight that derives from all the farmland use rights, and it is a transfer from public power to private power. But at the same time it is also limited, that is, must obey the state planning based on public interests. In clarifying the nature, this paper, based on the multiple features of rural land use in China, divides the rural land development right into the cultivated land development rights, the homestead right to development, and the business construction land development rights, and then discusses their ownership respec-tively.
