民国北京政府陆军司法刑事审判制度及其实施初探

摘　　要：民国北京政府军法审判制度基本沿袭了清末相关陆军的审判制度。北京政府陆续颁布了一些有关陆军刑律制度与司法审判的法规条例,并根据形势的变化作出了相应的调整与修正。同时,北京政府设有多层级的陆军审判机关,但是包括军法会审在内的各级军事审判与普通审判在司法实践层面上相当混乱,陆军军法会审制度有名无实。Basically,the military judicial system of the Republic of China（ Beijing Government） inherited the trial system of the Army in the late Qing dynasty. The Beijing Government issued a series of rules and regulations concerning the criminal law and judicial trial system of the Army,and made adjustments and amendments to keep pace with the changing situation. Meanwhile,it created multiple layers of military judicial organs; however,military justice and ordinary trials at different levels,including military joint trial,were practically in disorder. The military joint trial system of the Army only existed in name.
