摘　　要：环境保护政府动员型公众参与,是指在环境保护活动中,公众响应政府号召,以实际行动参与的现象。这种类型的公众参与,存在着组织化程度高、效率高、见效快的优势,也存在着行政机关容易违反行政法治中的正当程序原则和比例原则,以及公众被动参与、代价大、成本高等缺陷。在环境问题日益严重和依法治国的时代背景下,应克服不当因素的影响,牢固树立权利本位观,遵循法治原则,建设法治政府。The government- mobilized public participation in environmental protection refers to the phenome- non that the public actually participate in the environmental protection in answer to the call of the government. In this type of public participation, there is the advantage of high organization, high efficiency, and quick effect, but there are some defects such as the proneness of the administrative organ to violating the due process principle and the proportionality principle in the administrative law, the public＇s passive participation, the high price, and the ex- orbitant expenditure. Against the historical background of increasingly severe environmental problems and the rule by law, efforts should be made to overcome the impact of improper factors, to firmly establish the concept of right standard, to abide by the principle of rule of law, and to build a law - based government.
