农村土地市场化背景下非法转让、倒卖土地使用权罪研究

摘　　要：市场经济和城镇化背景下,农村土地使用权入市流转乃是大势所趋。刑法介入农村土地使用权的保护应以违反其他部门法为前提,惩治农村土地使用权流转中的违法行为应体现刑法的谦抑性。在非法转让、倒卖土地使用权罪的认定中,非法转让土地使用权应当以土地使用权的合法取得为前提,"非法"判断应当以土地管理法规的前置性判断为前提,非法转让、倒卖土地使用权罪的罪名应当调整为"非法转让土地使用权罪"。Under the background of market economy and urbanization, it is a general trend that the rural land use right enters themarket and circulates. The protection of the criminal law to intervene the right to use rural land shall be premised on the violation ofother department law, and the punishment of unlawful act under the jurisdiction of rural land use right circulation shall embody themodesty and restrained principle of criminal law. In the cognizance of crime of land use right illegal transfer or reselling at a profit,the illegal transfer of land use right shall be based on legal acquisition of land use right, the judgment of the＂illegality＂should bebased on the premise of prepositional judgment of land management regulations, and the accusation of＂crime of land use rightillegal transfer or reselling at a profit＂should be adjusted to＂crime of illegally transferring land use right＂.
