摘　　要：近年来,聚众斗殴案件愈来愈呈现出高发态势,然而聚众斗殴转化犯定罪问题不论在理论界还是在实务界均存有争议。本文拟结合转化犯现有的学术观点,列举出司法过程中出现的有关聚众斗殴转化的若干案例,在此基础上进行深入评析,以期厘清实务中如何定罪的困惑。In recent years, cases about affray increasingly showing a high incidence trend, but problem about the transformation of affray crime no matter in theory world or in practice world are controversial. This paper combined with the existing transformation crime theory and judicial practice case, researching on transformation convicted crime of affray, in order to solve the difficult problem of the judicial applicability in the transformation of affray crime.
