摘 要:当代国际私法已充分意识到保护弱者利益的意义和作用,劳动合同冲突规范对劳动者利益的保护即为例证。劳动合同法律适用的框架通常由当事人意思自治原则、最密切联系原则和强制性规则构成,国际私法对劳动者利益的保护也因此主要由这三种途径来实现。每种途径对劳动者利益的保护各有其优势和特点,但也有其不足之处,只有三种途径相互协调再辅以其他保护方法,国际私法对劳动者利益的保护才能周全。The modern private international laws attach great importance to the protection of the interests of the weak, which is exemplified in the protection of the laborers' interests. The methods of application of the law of labor contracts consist of the principle of party autonomy, the principle of most significant relationship and mandatory rules, so private international laws mainly adopt these three methods to protect the laborer' interests. But every method has its advantages and weaknesses, only when these three methods are coordinated with each other and complemented by other secondary methods, can private international law protect the laborers' interests thoroughly.
