读者借阅图书丢失、损毁引发的惩罚性赔偿问题探析

摘　　要：目前,许多图书馆对读者在借阅图书过程中出现的丢失、损毁图书现象,作出硬性规定,即读者要承担惩罚性赔偿责任。这种做法不仅违背了惩罚性赔偿的功能,而且不符合对此类行为追究侵权责任、违约责任的法律要求。合法的做法应是首先考虑让读者提供替代本,如无法提供,应根据丢失、损毁图书的实际价值等因素确定赔偿数额。If the borrowing books is lost or damaged by readers, many libraries require readers to be liable for punitive damages. This approach not only has violated the function of punitive damages, and do not conform to the infringement or breach of contract liability ruled by law, which shall be pursued for such behavior. The library should first order the reader to provide alternative, if reader cannot provide, it should determine the compensation amount based on the actual value of lost or damaged book.
