摘　　要：新近有不少学者认为,特别累犯的适用范围应继续扩展,但是支持这些见解的理由并不能令人信服。特别累犯扩展论不仅缺乏足够的法理正当性,而且完全不具有刑事政策上的必要性,今后对特别累犯的立法取向应保持限缩。Recently some scholars thought the scope of special recidivist should continue to expand.But the rea-sons supporting these viewpoints were not convincing.The expansion theory of special recidivist does not only lack enough legal legitimacy,but also lack the necessity of criminal policy.The legislation tendence of special recidi-vist should be restricted in the future.
