论老年法是相对独立的部门法

摘　　要：确立老年法是相对独立的部门法的地位,是进一步完善中国特色社会主义法律体系的必然要求,同时也有利于老年法的理论研究和进一步发展完善。传统的法律部门的划分标准有其合理性,但是我们也不能忽视其缺陷的存在。由于老年法所调整的社会关系的特殊性、老年法区别于其他法律的独有的特征以及待解决问题的紧迫性等,说明了其与行政法、民商法、经济法、社会法、刑法、诉讼法等是同一层次的、由宪法统帅之下的独立的法律部门。但是,鉴于目前我国法律体系中部门法划分的现状,我们还应当关注确立老年法独立的部门法地位与相关部门法的冲突问题。因此,老年法作为一个独立部门法的地位是相对的。由于社会关系的复杂性,在现实生活中几乎不存在只涉及单一社会关系的活动,老年法与其他部门法之间并无清晰的权限划分边缘,但是其在调整涉老社会关系以及解决问题的价值方面是其他部门法所不可替代的。The establishment of the elder law as a relatively independent branch is the inevitable requirement to further improve the socialist legal system with Chinese characteristics,and beneficial to the theoretical research and further development of the elder law. The traditional division of the legal department has its rationality,but we can not ignore its defects. Due to the particularity of the social relations it adjusts,its unique characteristics and the urgency of the problems it tries to solve,the elder law is in the same level as the administrative law,civil and commercial law,economic law,social law,criminal law,procedural law and the like,as an independent legal branch under the command of the constitution. However,in view of the current situation of the division of the department law system in our country,we should also pay attention to the conflict between the elder law and the relevant branches. As a result,the elder law as an independent branch is relative. Because of the complexity of social relations,there is no clear division of authority between the elder law and other branch laws,but its value in adjusting social relations and solving problems is not to be replaced by other branch laws.
