专利标准化权利边界及其反垄断法规制

摘　　要：专利标准化容易形成垄断,对专利标准化的反垄断法规制显得非常必要。现有反垄断法制度中并无针对专利标准化的权利确认,也没有其垄断性的明确判断标准和具体评估方法,更没有针对性的规制手段与程序。专利标准化权利具有正当性,也存在边界。专利标准化权利的边界主要是不侵犯他人专利权,不产生垄断,其中,不产生垄断的法律规制更需要完善。专利标准化反垄断法规制的具体构想包括应当明确专利标准化反垄断执法机构的职责,明确专利标准化垄断性判定步骤与判定标准,明确标准化机构专利政策的审查,健全专利标准化垄断的法律规制手段。Patent standardization is likely to create a monopoly, thus antitrust regulation of patent standardization is necessary. In the existing anti - monopoly law system, there is no confirmation of right for patent standardization, no clear criteria and specific assessment methods to judge the monopoly, also no targeted regulatory instruments and procedures. Patent standardization tight has legitimacy and boundary. The boundary of the patent standardization tight is not creating monopoly. Concrete ideas for the antitrust regulation on patent standardization include that clearing the duties of law enforcement agencies of the anti - monopoly to patent standardization, cleating determining criteria and determining step of patent standardization monopoly, cleating the review on patent policy of standardized institution, improving the regulatory means for patent standardization monopoly.
