政府与相对人土地冲突博弈的宏观成因与治理创新——以土地行政复议为例

摘　　要：研究目的:将土地行政复议作为观察政府与行政相对人的纠纷冲突、法律博弈与法治化解的典型样本,分析土地行政复议案件的宏观成因,研究化解冲突博弈的治理创新路径。研究方法:对29个省2006—2013年的面板数据进行描述性统计,应用动态面板模型进行分析。研究结果:从政府与相对人的冲突关系出发,选取相关变量,并进行实证检验,发现:(1)经济发展是促使土地行政复议发生的显著因素,地方政府"以地谋发展"的模式往往会侵害相对人的权益并引发冲突;(2)土地行政复议对政府行为的纠正能力越大,越能够约束政府行为,减少复议案件发生的数目。研究结论:转变经济发展方式必须改变地方政府对"以地谋发展"模式的依赖,以行政复议为切入点建设法治政府,推进政府治理能力现代化。强化复议的公信力,将政府与相对人的冲突更多地化解在复议环节。Administrative review of land is a typical sample about law game and way to solve the conflict between the government and administrative counterpart. Therefore, the purpose of this paper is to find macro factors prompting land administrative review, and study the innovation way to govern land use conflict. According to panel data containing 29 provincial units and the time span of 2006-2013, this paper makes descriptive statistics about macro factors of land administrative review. Dynamic Panel Data Model is used to complete the empirical test. Considering the conflict relation between the government and administrative counterpart in the process of rural land becomes non-agriculture, it chooses the variables which can influence land administrative review. The results of the empirical test indicate that economic development is the significant factor which increases the number of the administrative review cases. The local government＇s behavior that promotes the economic development by excessively using land resource and relies on the differential rent is the root of conflict. Administrative review can correct the wrong behavior of the government, and this function can reduce the amount of administrative review cases. The conclusions and policy recommendations are local government＇s development mode which relies on the land resource and differential rent should be changed. The transformation of the government＇s function and justice administrative review, can strengthen the public trust in administrative review.
