论政府经济管理权的理性收缩——以有限政府理论为分析框架  

On Rational Shrink of Government Economy Management Power——From the Perspective of Limited Government Theory

摘　　要：政府经济管理权是现代市场经济条件下政府运用"国家之手"调节宏观经济运行的一种法定权力。政府经济管理权从其本质属性而言是经济法域中的权力,具有典型的公法行政权力属性。政治国家之行政权力在对市民社会运行调节过程中鉴于其自身特点,具有自我膨胀性和侵益性,这就要求从其作用的范围和方式等方面进行理性收缩。自然法学派有限政府理论对于政府权力控制的论证能够为现代政府经济管理权的理性收缩提供了一个完整的分析框架,解决政府经济管理权理性收缩的问题,进而契合党的十八届三中、四中全会提出的简政放权的执政理念。Government economy management power is a statutory power to regulate macro-economy operation in modern market economy.Government economy management power is in nature an economical power,with a typical public law nature.Because of its characteristics,executive power of political states can have self-expansion and benefit invasion in the process of regulating civil and social operations.Thus,rational shrink is needed in terms of scope and pattern of its operating.Limited government theory of the nature law school can provide a whole analytical frame for rational shrink of government economy management power.It can solve the problem of rational shrink of government economy management power,and highly corresponds with the decentralization spirit of the 3rd and 4th Plenary Session of the 18 th Central Committee of the Community Party of China.
