摘 要:欧盟对军民两用产品的出口控制已经被纳入欧盟的共同商业政策领域,属于欧盟的专有权能范畴,但也仅仅是部分地统一到欧盟层面,成员国仍保留很大的自由裁量权力。面对新的国际形势,欧盟着手对该制度进行改革,一方面欧盟既要对这类产品实施统一的控制,另一方面又不能因为控制而阻碍这类产品参与国际竞争,需要在这两方面进行平衡。这实际上是欧盟的对外贸易政策与安全政策的一次"碰撞"。我国应抓住欧盟两用产品出口控制制度的特点与目前欧盟加紧着手立法改革的契机,争取其放松对华高技术产品出口的限制,使其尽快解除对华军售禁令。Dual-use export controls constitute an exclusive competence of the European Union and form an integral part of the EU's Common Commercial Policy. However, the implementation and enforcement of dual-use export controls is still to a large extent in the hands of member states. Facing rapidly changing technological,economic and political circumstances, EU is engaged in the review and modernization of the present system with the aim of a more integrated export control regime ensuring security and a more level playing field. For that purpose, EU needs to strike a right balance between trade policy and security policy. China could take the advantage of the features of dual-use export control of EU and seize the opportunity of EU's reform to relax the restriction on export of high tech products to China, trying to remove the arm embargo towards China as soon as possible.
