摘 要:行政规划裁量基准是全部行政裁量基准制度的重要组成部分。上升到国家战略和依法治国层面的行政裁量基准制度,是包括行政规划在内更为广泛的一种体系化、多元化的制度。行政规划法及其裁量基准具有独特的法律个性,其规范构造通常不是采用"要件-效果"范式,而是采用"目的 -手段"范式,其裁量基准建构也不是采用"情节细化"与"效果格化"的逻辑,而是遵循"目的细化"与"手段细化"的路径。对规划裁量的法律治理可以采用内外监控、"他制与自制"并举的混合规制模式。The standard of the administrative plan discretion is an important part of the administrative discretion. As the standard of administrative discretion system becoming part of the Country Strategy and the institution of lawfully manage state affairs, it turns into a more aide -ranging, systematization, many -faceted system, and the administrative plan is a part of that system. The law of administrative plan and its standard of discretion is unique, its specific paradigm is ' purpose and means' instead of the ' conditions and effects'. The formation of the standard is not based on the logic way of ' specific conditions' and ' reticulation effects' , but to ' specific purpose' and ' specific means'. The legislative regulation mode can combine the mixed the mode of inside - control and outside - control with the mode of the self - control and others - control.
