侵权法上权益保护模式的比较与镜鉴——兼论违法性展开与限制因素的运用

摘　　要：所谓权益一体保护模式,是指一国法律在保护权益时不将权益区分为权利和其他受法律保护的利益而予以一体保护的模式,其中以法国侵权法最为典型。所谓权益区分保护模式,是指一国法律在保护权益时将权益区分为权利和其他受法律保护的利益并给予不同程度保护的模式,其中以德国侵权法最为典型。在权益的保护上,是采取权益一体保护模式还是权益区分保护模式,采取不同的保护模式是否会对权益的保护产生实质性影响等问题,是实现侵权法对权益保护应解决的首要问题。藉由两种保护模式的比较研究,探寻一条适合我国侵权法上权益保护模式。在此基础上,进一步探寻违法性展开与限制因素的运用。The integration of rights and interests protection mode refers to national laws whioh do not distinction rights from other interests protected by law, such as the code civil. The distinction of rights and interests protection mode refers to national laws distinction the rights from other interests protected by law, such as the BGB. Whether shall we take integrated protection mode or take protection mode will have a substantial impact. By the comparative study of two protection modes we intend to find a suitable protection mode in our country on this basis, we further seek the use of illegality expansion and limiting factor.
