摘　　要：商谈规则主要包括基本逻辑规则、普遍证立规则以及商谈资格和商谈方式的规则。在我国立法过程中,基本逻辑规则能够保证立法商谈参与者客观获取对方信息并且让对方准确接收自己的信息,普遍证立规则能够保证立法商谈参与者的主张建立在充分理由论证之上,商谈资格和商谈方式的规则可以保证立法商谈参与者的广泛性,立法商谈参与者自由发表意见的权利以及不受强迫干扰的权利。要充分运用商谈规则,需要提高参与主体的立法商谈能力,并且从公共领域、人大制度与耦合机制三个层面加强立法商谈场域的建设。Discourse rules mainly include the rules of basic logic, generally proved and the rules of discourse qualification and ways. In the process of legislation in our country, the rules of basic logic can guarantee the participants of legislation discourse objectively receive the others＇ information and let the other side receive their information, generally proved rules can guarantee the claims of the participants of legislation discourse are based on good reason to demonstrate, the rules of discourse qualification and ways can guarantee the ways of universality, the right to freedom of opinion and not to interfered by force. To make good use of the rules of discourse, we need to improve the discourse ability of the participants of legislation discourse and strengthen the construction of the discourse field from three aspects of the public domain, the National People＇s Congress system and the coupling mechanism.
