摘 要:在线解决争议方式(ODR)所具有的高效性和便捷性使其在很多情况下已成为电子商务纠纷中消费者获得法律救济的唯一机会。其中,网上法庭因其自身优势如法官享有较高威望、裁决结果具有强制力、更大的公共财政支持以及正当程序保障而具有私人ODR所不可替代的作用。着力构建适应我国电子商务纠纷解决需要的网上法庭机制尤其是在线小额索赔程序是增进公众对电子商务信心的重要举措。在设法消除对前述机制可能的顾虑并做好应对相关挑战的准备的基础上,我们应借鉴各国经验,结合我国现有规定和已有实践,对未来的在线小额索赔程序进行具体设计并加快推进机制建设。In many situations,online dispute resolution( ODR) is the only access to justice for consumers involved in e-commerce disputes due to its efficiency and convenience. It is worth mentioning that the cybercourt plays a role that private ODR cannot replace because of its advantages such as judges enjoying high prestige,binding outcomes,greater public financial support,and guarantees of due process. Building a cybercourt mechanism,especially an Online Small Claims Procedure meeting the needs of China's e-commerce dispute resolution is an important initiative to improve public confidence in e-commerce. Managing to eliminate possible concerns over this mechanism,preparing for meeting challenges of creating a cybercourt,and learning from the experience of other countries,we should,based on existing regulations and practices in China,design the future Online Small Claims Procedures in detail and accelerate the construction of this mechanism.
