关于上海高校和科研院所职务科技成果产权管理体制改革

摘　　要：高校和科研院所是上海创新资源的集中地,相关科研人员是重要的创新主体。创新成果的产权归属、处置和收益问题,既直接影响相关科研人员的创新动力,也是科技成果转化应用的前提基础,是事关上海科技创新的基础性、本源性问题。建议扩大高校和科研院所对职务科技成果处置和收益的自主权;加快制定对职务发明人及相关人员的激励机制;提高发明人对职务发明成果的处置和收益权;积极探索职务科技成果"单位和发明人共有模式";成立专业化、市场化运作的知识产权运营公司,以及完善配套制度。Universities and research institutes are the focus of innovation resources in Shanghai,and related scientific research personnel is an important subject of innovation,the issue of property rights,disposal and profit of their innovation results,not only it has the direct impact on the innovation of scientific research personnel,but also the prerequisite for the transformation of scientific and technological achievements,furthermore,it is the foundation and the source of the problem matters the Shanghai science and technology innovation.We suggest to expand the autonomy of universities and scientific research institutes to the disposal of scientific and technological achievements and benefits;speed up formulate the incentive mechanism for the inventor and the related personnel;improve the disposal and the right of the inventor to the invention of the position;actively explore the work of scientific and technological achievements of 'a total model of the unit and the inventor';establish specialized,market-oriented operation of the intellectual property rights operation company,and improve the supporting system.
