摘　　要：权利用尽原则是知识产权法中非常重要的一个原则,其本质应是平衡利益。植物新品种权的权利用尽主要体现在销售流通环节的权利用尽,其有着严格的适用要件。基于知识产权法相关规定和实践展开分析,我国植物新品种保护领域同样适用权利用尽制度。Exhaustion of Rights principle is a very important principle in the law of intellectual propertyand, its essence is to balance the interests.The exhaustion of rights of new plant variety right is mainly embodied in sales of circulation,it has the strict applicable condition. Based on analyzing the regulations and practice of the relevant intellectual property law, in our country new plant varieties protection fi eld also applies to the exhaustion of rights system.
