摘　　要：虽然责任转质在实践中有极大的需求,其运用也与物尽其用、保障交易安全的现代物权法大趋势相一致,但由于其有可能给质物所有权人带来极大风险以及违背某些传统物权法理论等原因迟迟未纳入立法。在周密的制度设计下,如何将风险降低到最小以保障利益的公平是使这一制度扬长避短,发挥其功效的关键。Although there＇s a great demand for liability ~pledge in practice, and its application is in line with the main trend of modem real right laws which emphasize making the best use of properties while guaranteeing the security of transactions, liability repledge hasn＇t been legislated because it may pose huge risks to the ple^ng owner or go against some traditional theories of real right law. To make best use of the advantages of this system, it,s imperative to design an elaborate system and try to reduce the risks to a minimum level fox the protection of fair interests..
