摘　　要：随着民主政治的发展,日常的政治活动中已经形成了严密的规则,国家权力的运行在规则的框架内进行,既依赖于这些规则的实施,又受到其严格控制。在法治民主的条件下,该规则指的是法治规则,政治主体之间在法治规则的框架下展开可控的、非暴力的冲突,此时的政治冲突被称为规则冲突。可以说规则冲突是法治民主的典型形态,其不仅确保了政治冲突活动的规则性与合理性,也在很大程度上避免了政治冲突因行为不当或失控而形成暴力政治冲突的可能性,是发现和传播政治真理所必不可少的。在法治的视野下对规则冲突加以研究,探索建立规则冲突的政治机制,不仅可以打破冲突对峙的僵局,还可以降低政治运行过程中所耗费的交易成本和安全成本。With the development of democratic politics,strict rules have formed in daily politics.State power operates within the framework of rules,not only relying on the implementation of these rules,but also under its strict control.Under the condition of constitutional democracy,the rule refers to the rule of nomocracy.In the framework of the rule of nomocracy,political subjects develop controlled,non-violent conflicts.At this time,the political conflict is known as regular conflict.It can be said that the regular conflict is the typical form of constitutional democracy,it not only ensures that the regularity and rationality of the political conflict activities,but also largely avoids the possibility of a violent political conflict formed due to improper or out of control conduct in political conflict.Regular conflict is essential to discover and spread political truth.This paper researches on the regular conflict in the view of rule of law,and explores the political mechanism to establish regular conflict.This can not only break the conflict confrontation deadlock,but also can reduce transaction costs and security costs consumed in the process of political running.
