《体育法》定义条款问题探析

摘　　要：从法律文本定义条款规范及功能出发,论述设置定义条款是国外体育基本法立法者通常考虑的问题,分析我国现行体育基本法《体育法》缺失定义条款引出的主要问题,探讨目前《体育法》增设定义条款存在的风险。认为《体育法》定义条款的缺失不仅是法律文本规范问题,对法律功能也有影响;同时,限制了法律在体育领域中的作用;还存在对体育领域新形势的不适应和阻碍国际体育交流的问题。目前《体育法》设置定义条款的风险仍然存在,但是随着理论来源的扩展、立法环境的变化和认识基础的趋于统一,我们已经有了较好的条件可以充分预见危险性并妥善解决。因此,《体育法》设置定义条款虽有风险,但应当前行。以此为基础,借鉴国外体育基本法经验及相关体育理论,以我国立法实践为参考提出了修订《体育法》,增设定义条款的具体设想。This paper analyzed the problems for the shortcoming of definition clause in Sports Law and other nation usually established definition clause insports law text from the effect and legal texts of theory and some rules,discussed the dangerous of established definition clause. It is found that this problemlimited the function of law in sport domination and the dangerous of established definition clause exist now. However,we can foresee and solve it easily thanbefore with the expansion of the theory,the change of the legislative environment,the understanding of the basis of the unity. Thought it is a risk in settingdefinition clause in Sports Law,we should do it. Based on these views,the author proposed amendment of Sports Law,and added the definition clause.
