摘 要:我国现行的法律、法规没有对业主委员会的性质、法律地位进行明确,同时,业主委员会的监督机制也不完善。立法的缺失带来司法的迷惘,不仅增加了解决物业纠纷的难度,而且对业主的救济不利。本文以此为立足,从业主委员会和业主、业主大会的关系,民事主体资格、诉讼主体资格的确认,监督制度的反思等方面论述我国业主委员会的制度构建,以期引玉。Current laws and regulations fail to explicitly determine the nature and the legal status of owners committee,and the surveillance system also embodies some weakness.The absence of legislation has brought about certain confusion,which not only makes it hard to conciliate property disputes,but also provides insufficient judicial relief to owners.This text takes the status quo as a starting point,expounds on the construction of the system of owners committee of our country from perspectives of the relationship between owners committee and owners,relationship between owners committee and owners meeting,qualification of civil subject,the determination of the qualification of litigation subject and reflections on the surveillance system and so on.
