摘　　要：质权通过交付设立,该交付是否可以通过指示交付的方式设立众说纷纭。该交付仅限于现实交付,指示交付将导致该质权效力的不完备以及其实现上的困难。在存在动产抵押的法律框架下,再承认指示交付设立质权的途径不再必要。There is no consensus in delivering the pledge right established whether that delivery could be es- tablished by means of instruction delivered opinions. This article is limited the delivery of the actual delivery, indicating delivery will make the pledge right and the effectiveness of incompleteness difficult to achieve. In the pres- ence of chattel mortgage legal framework, and then it recognizes the delivery route and indicates it is unnecessary to establish the pledge right.
