摘  要:禁止职业歧视的价值基础决定职业歧视概念及相关法律制度的立法和司法建构。围绕这一问题先后出现了抵消先天优势的平衡自然抽签理论,确保合理关联的维护市场理性理论以及禁止侮辱贬损的尊重人格尊严理论等作为禁止职业歧视价值基石的主张。但对各国立法及司法实践情况的考察表明,推进社会融入是真正支撑禁止职业歧视法律制度的价值基础。这体现在法律保护的对象是社会融入程度不足的被排斥群体,法律措施演进的动力源于解构妨碍社会融入障碍的需要,司法救济模式调整的目的是提升被排斥群体社会融入水平等各个方面。The value basis of prohibition of employment discrimination determines the concept of era- ployment discrimination as well as the legislative and judicial construction of relevant legal system. A round this problem, there appeared proposals to place theories such as balancing natural lottery to offset inherent advantages, maintaining market rationality to ensure reasonable relevance and respecting human dignity to prohibit insulting and derogating etc. as the cornerstone of employment discrimination law. However, anti--discrimination legislation and judicial practice around the world demonstrates that pro- motion of social inclusion is the major value basis supporting the whole employment discrimination legal system. This is reflected in various aspects of employment discrimination legal system, such as the pro- tected objects are excluded groups with low levels of social inclusion, the development drives of anti--dis- crimination legal measures come from the need to deconstruct barriers impeding social inclusion as well as adjustments of judicial remedy modes aiming at enhancing inclusion levels of excluded groups.
