摘　　要：持有型犯罪不是现代性的犯罪,而是一个古老罪名,在古代中国几乎是与刑律同步演进的。它具有立法和适用的广泛性、惩治的严厉性,全面地从政治、社会、精神领域进行干预,典型地表现出维护封建社会等级制度和王权制度的特点。Instead of a modern-invention, illegal possession crime is an ancient-long crime which almost evolved simultaneously with the criminal laws of the country. Characterized in wide applicability and severe punishments, the crime was aimed to intervene into political, social and ideological fields with obvious purposes of maintaining feudal social hierarchy and regal system.
